Terms and Conditions

These Terms and Conditions apply to your use of the MELANI website and all orders placed through our online store. By using our website or placing an order, you agree to these Terms and Conditions and our Privacy Policy, Delivery Policy and Returns Policy.

By placing an order, you confirm that you are legally capable of entering into a contract, that the information provided is accurate and that you are authorised to use the selected payment method.

Product Information

All photos on this site are for reference only.

All sizes and measurements are approximate. Slight variations may occur due to fabric characteristics, manufacturing processes and measurement methods.

We take reasonable care to ensure that product descriptions, photographs, prices and promotions are accurate. If an error affects your order, we will notify you and offer you the option to reconfirm or cancel the affected item.

Nothing in these Terms affects your statutory rights concerning goods that are faulty, damaged, incorrectly supplied or do not match their description.

Stock Availability

All products are subject to availability. Placing an item in your shopping bag does not reserve it.

Preorder and backorder items will display on the relevant product page.

If an item becomes unavailable after you place an order, we will notify you as soon as possible. You may choose to wait, select an available alternative or cancel the affected item for a full refund to your original payment method.

Pricing

Prices and promotions may change before an order is accepted. Changes will not affect an order already accepted, except where there is an obvious pricing error and to the extent permitted by law.

Online prices and promotions may differ from those offered at our retail stores or through other sales channels or our retail shop. The price applicable to your purchase is the price displayed through the sales channel where you place your order.

Delivery charges are shown at checkout. International orders may also be subject to customs duties, taxes and other destination charges.

If we discover an obvious pricing, product or promotional error before accepting your order, we will ask you to reconfirm the order using the correct information or cancel it for a full refund. If we cannot contact you within a reasonable time, we may cancel the affected order.

Payment

We currently accept Credit Card, Alipay, WeChat Pay, FPS, Google Pay and Apple Pay. Available payment methods are displayed at checkout and may change from time to time.

You must be authorised to use the payment method submitted. Payments may be subject to authorisation, verification and fraud-prevention checks.

We may refuse a payment that is declined, unauthorised, incomplete or reasonably suspected to be fraudulent or unlawful.

Orders and Acceptance

Please check the products, sizes, colours, quantities, delivery details and total price before submitting your order.

After you place an order, we will send you an acknowledgement email. This confirms that we have received your order but does not mean that it has been accepted.

Your order is accepted, and a contract is formed, when we email you to confirm that the goods have been dispatched. If items are dispatched separately, each item may be accepted when it is dispatched.

We may refuse or cancel an order for legitimate reasons, including:

product unavailability;
an obvious pricing or product-information error;
payment failure or suspected fraud;
an incorrect or incomplete delivery address;
shipping restrictions; or
circumstances outside our reasonable control.

If we cancel an order after collecting payment, we will refund the affected amount to your original payment method. Your bank or payment provider may require additional time to process the refund.

Cancellations and Amendments

Once an order has been submitted, we cannot guarantee that it can be cancelled or amended, including changes to the delivery address.

Please contact us as soon as possible if you need assistance. If the order has already been processed or dispatched, you may request a return after receiving it in accordance with our Returns Policy.

This does not affect your statutory rights.

Promotions and Discount Codes

Promotions and discount codes are subject to their stated terms and availability. Unless otherwise stated:

only one promotional code may be used per order;

promotional codes cannot be exchanged for cash or applied after an order is placed; and

promotional codes cannot be combined with other offers.

If a return causes an order to fall below a promotional or free-shipping threshold, the refund may be adjusted to reflect the promotion applicable to the items retained, as explained in our Returns Policy.

Delivery and Customs

Delivery methods, charges are set out in our Delivery Policy.

Delivery times are estimates and are not guaranteed. Delivery may be affected by courier disruption, severe weather, transportation delays, customs procedures and other circumstances outside our reasonable control.

Responsibility for the goods passes to you when they are delivered to your stated address or collected by you or someone authorised by you.

International orders may be subject to import duties, taxes, customs fees and other charges imposed by the destination country or region. Unless otherwise stated at checkout, these charges are not included in the product price or delivery charge and must be paid by the recipient.

Customs authorities may inspect, delay, detain or restrict a shipment. We will provide reasonable assistance where appropriate, but customs decisions and processing times are outside our control.

Returns, Exchanges and Refunds

Returns, exchanges and refunds are governed by our Returns Policy.

Our voluntary return conditions do not limit your statutory rights concerning goods that are faulty, damaged, incorrectly supplied or do not match their description.

Approved refunds will normally be issued to the original payment method.

Website Content and Use

We may correct or update website content, prices, promotions and product information at any time. Changes will apply prospectively and will not normally affect orders already accepted.

All website content, including text, photographs, graphics, logos, trademarks, designs and videos, is owned by or licensed to MELANI. It may be used only for personal, non-commercial purposes and must not be copied, modified, distributed or commercially exploited without our written permission, except where permitted by law.

You must not use the website for any unlawful or fraudulent purpose or attempt to interfere with its operation, security or accessibility.

Liability and Events Outside Our Control

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

To the maximum extent permitted by law, MELANI will not be liable for indirect or unforeseeable losses or for delays and failures caused by circumstances outside our reasonable control.

Such circumstances may include severe weather, natural disasters, government action, customs restrictions, transportation disruption, courier failure, industrial action, interruption of essential services or other events we could not reasonably prevent.

If such an event prevents us from fulfilling your order, we may cancel the affected item and refund any amount paid for goods that have not been supplied.

Nothing in these Terms excludes, restricts or affects your statutory rights as a consumer.

Privacy

We handle personal data in accordance with our Privacy Policy and applicable data-protection laws.

Changes to These Terms

We may update these Terms and Conditions by publishing a revised version on our website. Changes will apply from the date of publication and will not affect orders already accepted, unless required by law.

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply.

A person who is not a party to a contract between you and MELANI has no right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) to enforce any part of that contract.

Governing Law

These Terms and Conditions and all contracts between you and MELANI are governed by the laws of the Hong Kong Special Administrative Region. The Terms and Conditions, Delivery Policy, Return Policy and the Privacy Policy should be read together. If there is any inconsistency concerning delivery, returns or personal data, the policy dealing specifically with that subject will apply, subject to applicable law.

Subject to any mandatory rights available under applicable law, the courts of the Hong Kong Special Administrative Region shall have non-exclusive jurisdiction over any dispute.
